The two Appellants who are brothers were jointly and
together charged and convicted by the District Court of Bagamoyo at Bagamoyo
with the offence of gang rape. Notwithstanding that the Appellants denied the
charge, they were each convicted as charged and sentenced to serve life
imprisonment. Aggrieved, they preferred a joint appeal to the High Court
against both conviction and sentence. As it were, their appeal was unsuccessful
and their convictions and sentences were sustained. Still dissatisfied, they
lodged this joint appeal.
