The applicants were convicted of robbery with violence by a subordinate court. They appealed to the High Court but their appeal was dismissed. They further appealed to the Court of Appeal but their appeal was dismissed yet again. In this application, the Applicants sought leave to file application for review out of time. The reason they gave for failure to file an application in time is that there was scarcity of stationeries and typewriters in prison. The counsel for the Respondent urged the Court to dismiss the application because it was unfounded as the alleged reason of delay was unsubstantiated. The major issue for determination by the Court was whether the delay was explained away by sufficient reason.
