The Appellant was charged with and convicted of statutory rape before the District Court of Shinyanga. Dissatisfied with the decision he appeal to the High Court complaining about the credibility of evidence on the question of the victim’s age; that some witnesses were not summoned to testify; that their relationship was consensual and he intended to marry the victim and that he faulted the victim’s evidence that he was circumcised.
