The Appellant was charged with the offence of rape contrary
to sections 130 and 131 of the Penal Code. He was convicted on his own plea of
guilty and was sentenced to life imprisonment. It transpired that when pleading
guilty to the offence the facts fell short of establishing the offence of rape.
Having lost his appeal to the High Court the Appellant appealed to the Court of
Appeal. The Court considered a situation where a plea of guilty to an offence
is not backed up by the facts.
