The Appellant was charged with armed robbery before the District Court at Tarime. The owner of the depot and money that was stolen did not testify. The Appellant was convicted and sentenced to 30 years of imprisonment and to suffer corporal punishment of twelve strokes of cane. He was aggrieved and appealed to the High Court where his appeal was dismissed. He then appealed for the second time to the Court of Appeal. His appeal was grounded on the insufficiency of identity evidence, the prosecution’s failure to establish the offence as the owner of the stolen property did not testify, and contradictions in the prosecution’s evidence.
