The Appellant was charged with, and on his own plea of guilty, was convicted of manslaughter of his wife. Although the learned trial Judge thought “the mitigating factors were truly commendable” he sentenced him to ten years’ imprisonment in order to discourage “the age-long habit of senseless wife beating.” The Appellant was aggrieved by this severe sentence and appealed. It was argued on behalf of the Appellant that the sentence was excessive and that the trial judge considered extraneous matters while mitigation was “truly commendable” as he had noted in his judgment. The counsel for the Respondent conceded that the parties did not raise the issue of “the habit of age-long senseless wife beating.”
