This appeal originates from the judgment of the High Court of Tanzania sitting at Songea and acquitting the Respondent, of murder contrary to the law. Aggrieved by the decision of the High Court, the Appellant appealed to this Court contesting the acquittal on seven grounds of complaint, which, in essence, raised issues on the applicability of the doctrine of recent possession as well as oral confession as a legal basis for a conviction for murder. The issue before the Court was whether or not the appeal proved the case to the standard required by the law.
