The Appellant together with another person were charged with
and convicted of robbery with violence. His appeal to the High Court was not
successful and so the Appellant appealed to the Court of Appeal. On appeal the
Appellant challenged the decision of the High Court on the following grounds.
First, that there was unsatisfactory evidence of identification in that lamp
light was used, second, that he had an alibi and that the High Court did not
fully evaluate the evidence which was before the trial court and as a result
wrongly dismissed the Appellant’s appeal to the High Court. The Court
considered the grounds that were raised.
