When the appeal was called for hearing the court was faced
with the preliminary objection to the effect that: “the record of Appeal is
invalid for having an undated judgment of the Honourable Mr. Justice Kalegeya
(as he then was) at page 442 of the Record of the Court of Appeal filed on 14th
August, 2008”. The preliminary objection was filed with prior notice on 17th
February, 2009 under rule 100 of the Court of Appeal Rules.
