The Appellant who was convicted of unnatural offence was
sentenced to thirty years’ imprisonment whereupon he unsuccessfully appealed to
the High Court of Tanzania. He further appealed to the Court of Appeal of
Tanzania challenging the decision of the High Court on the ground that his
guilt had not been proved beyond all reasonable doubt because the conviction
was based on the uncorroborated unsworn testimonies of PW1 and PW2.
