The Appellants were convicted in absentia of assault
causing actual bodily harm and sentenced to the maximum punishment provided by
law, that is to say, five years’ imprisonment. They instituted this appeal
against conviction and sentence while not serving the prison sentence. Republic
raised several preliminary objections including that since the convicts had not
served their sentence, the appeal against sentence which they had not served
was pre-mature.
