The applicant, aggrieved by the decision in Tribunal Appeal
No. 2 of 2008 by Fair Competition Tribunal, preferred this revision application
challenging the ruling delivered by Sheikh, J. dated 30th day of
September 2008. In the Court of Appeal, the applicant challenged the Tribunal
for failing to give the applicant the right to be heard. The Court of Appeal
considered its powers to call for and examine the record of any proceedings
before the High Court for the purpose of satisfying itself as to the
correctness, legality or propriety of any finding, order or any other
proceedings of the High Court.
