The Appellants were convicted of murdering one Hamisi Mnino
and sentenced to suffer death by the High Court. The Appellants faulted the
decision of the High Court in basing the conviction on the prosecution case
that the Appellants were the last persons to be seen with the deceased and in
their respective statements they admitted killing the deceased. The High Court
decision was also challenged on the ground that it did not fault the trial
court which allowed assessor to cross examine witnesses.
