The Appellants were charged with and convicted of armed robbery
by a Resident Magistrates Court. They were each sentenced to thirty year’s
imprisonment. Aggrieved by the decision of the trial court they appealed
against both conviction and sentence. One of the grounds of appeal was that in
convicting them the trial court relied on very weak identification testimony of
PW1 and PW2, without cautioning itself on the dangers of acting on such
testimony. The Appellants also raised the issue of contradictory accounts of
the same incident. The High Court considered all the grounds raised.
