The Appellants were charged with the offence of armed
robbery in Morogoro District Court. After the trial, they were convicted and
sentenced to a thirty-year term of imprisonment. They appealed to the High
Court but their appeal was dismissed and they then preferred this appeal to the
Court of Appeal. Their main ground of appeal was that they were not properly
identified. The counsel for the Respondent contended that the Appellants were
sufficiently identified as conditions favourable for visual identification
existed. The central issue for determination by the Court was whether the
Appellants were identified and possibilities of mistaken identity were
eliminated.
