The Applicant filed this application praying for an order
for extension of time within which to institute an appeal and an order for stay
of execution of the decree pending the hearing and determination of appeal. The
appeal which the Applicant intended to make was against an ex-parte
judgment. The High Court considered whether an order for stay of execution of
the decree pending the hearing and determination of appeal can be made where no
appeal has been instituted.
