When this matter was called for hearing, the Court was
called upon to decide on two issues. One, on the practicability of complying
with rules 36 and 106 of Court of Appeal Rules, 2009 that came into effect in
2010 while the appeal was filed in 2009 as required by rule 130 and two,
whether the Court can proceed with the hearing of the Appeal using defective a
Decree.
