The Appellant was charged with and convicted of rape. He was
sentenced to life imprisonment. His appeal to the High Court was unsuccessful.
He appealed to the Court of Appeal on three grounds. First that refusal by the
trial magistrate to hear out the Appellant’s witnesses violated his right to a
fair hearing. Secondly, there was general insufficiency of evidence in proof of
the charge against him and thirdly that the trial magistrate and the first
appellate court erred in arriving at a conviction relying on the PF3 without
the evidence of the doctor who performed the medical examination upon the
victim.
