An application for review was filed in a resident
magistrate’s court under section 95 and Order XLII rules 1 and 3 of the Civil
Procedure Code. The court struck out the application holding that it was
brought under the wrong provisions of the law. The Appellant appealed to the
High Court complaining that the trial court struck out the application on
fictitious grounds.
