The Appellant was charged with the offence of rape in the District Court of Songea. He was convicted of attempted rape and sentenced to 30 years’ imprisonment. He unsuccessfully appealed to the High Court. He further appealed to the Court of Appeal complaining that he never committed rape and that he was wrongly convicted of attempted rape while he was charged with rape. The Court of Appeal considered whether he was properly convicted.
