The Appellant was charged with the offence of grave sexual abuse. He was convicted and sentenced to 20 years’ imprisonment. His first appeal to the High Court was dismissed. In his second appeal to the Court of Appeal he had the following grounds, namely that his defence was not considered, that no proper voire dire examination was conducted in respect of PW2 (i.e. the girl) before testifying; and that PF3 was admitted in evidence without calling the doctor who examined the victim and it was not properly signed.
