The Applicant had filed a suit in the High Court to seek
indemnity from the Respondent for the loss of his vehicle but the High Court
struck out the suit on account of want of pecuniary jurisdiction. The Applicant
filed an application for review of that judgment on the ground of discovery of
new and important matters of law and fact affecting the merits of the court’s
judgment which were not presented to the court during the trial. The Applicant
claimed that the decision under review was in conflict with the previous
decision on the same question of jurisdiction between the same parties.
