The Appellants are challenging the judgment of the District Land and Housing Tribunal which made an order that they should be evicted from the suit plots. The Appellants are claiming ownership of land, alleging that they purchased the same during the life of Kindi Salim for whose estate the present Respondent was appointed as an administrator. The trial tribunal dismissed the Appellant’s allegation because there was no evidence adduced to prove the purchase of the suit land. Further, that those who are allegedly to have sold the suit land to them were not the legal representatives of the deceased and could, therefore, not pass title to the Respondents. Aggrieved by the decision, they decided to appeal to this Court. Among other grounds, the Appellants faulted the decision of the trial tribunal for the failure to join the seller of the disputed land as a necessary party and for the change of trial tribunal’s Chairpersons in the same matter without informing the parties.
