The Respondent filed an application Before the Tribunal against the Appellant seeking for an order for vacant possession and costs of the application. It was alleged that the Appellant had refused to vacate the suit premises at the expiry of the time of the lease. The squabbles emanated from a lease agreement entered into between the husband of the Respondent as the landlord on the one hand and the Appellant as the tenant on the other. The Tribunal decided that the lease agreement had not expired at the time it determined the dispute and that the agreement was indeed between the Appellant and the husband of the Respondent, yet it held that the Respondent could get into the shoes of her husband in respect of the agreement and it ordered the Appellant to vacate from suit premises at the expiry of the lease period for avoidance of institution of the same case in future as the parties’ relationship had been tainted.
