This application originates from civil case No. 5 of 2010 which was determined by the Resident Magistrate’s Court at Tanga in favour of the first Respondent. The trial court proceeded to grant a decree which has already been executed by way of attachment of a motor vehicle with Reg. No. SU 37175 TOYOTA DYNA 4 tones Truck. There is no appeal pending in this Court against the said decree. The Applicant is praying to stay the execution of the decree of ex-parte judgment.
