The Appellant appeared before the Court of Resident Magistrate of Tanga at Tanga to answer a charge sheet containing two counts of Conspiracy to commit an offence contrary to section 384 and armed robbery contrary to section 287A of the Penal Code [Cap 16 R.E. 2002]. After due trial, the Appellant was found guilty and convicted of both counts. His appeal to the High Court was dismissed in its entirety hence an appeal to the Court of Appeal. The main issues on appeal included the propriety of conviction on the conspiracy count and whether a court, at any stage of a trial or other proceeding, may summon any person as a witness if it appears to the court that the evidence of such person is essential to the just decision of the case.
