The Appellant was charged with two counts of shopbreaking and stealing in a District Court. It was alleged by the prosecution that the Appellant had on 27th December 2009 at about 20.00 hours at Isusumya village within Kondoa District, in Dodoma Region, broken, entered and stolen some properties that belonged to a shop of one Shaibu s/o Juma. The Appellant denied to have committed the offence. Nevertheless, in the end, he was convicted. He was aggrieved and decided to appeal to the High Court of Tanzania.
