Respondents intended to demolish the properties of the Applicant. Before filing a Plaint, the Applicant applied to the court seeking for interim injunctive orders against the Respondent. In support of his prayer, the Applicant submitted that it had been necessary to seek for the said prayer to avoid suffering irreparable loss in the event the intended demolition was carried out by the Respondents. The Respondents replied that the application itself was incompetent before the court as it was not accompanied with a Plaint and no notice was issued to the Respondents.
