The Appellant was convicted as charged by the District Court of Iramba at Kiomboi of the offence of Rape contrary to section 130(2)(e) of the Penal Code. The accused person was consequently sentenced to serve thirty (30) years term of imprisonment and to suffer twelve (12) strokes of the cane. Dissatisfied with the conviction and sentence the Appellant filed his appeal in the High court intending to impugn the decision of the trial District Court. The Appellant was convicted on the strength of evidence of PW1 and PW 2 who were eye-witnesses.
