The Appellants were charged in the District Court of Arusha, at Arusha in Criminal Case No. 522 of 2009 with two offences of armed robbery contrary to section 287A of the Penal Code. They were convicted and sentenced to 30 years’ imprisonment each. The conviction was based on their cautioned and extra judicial statements they made. Their appeal to the High Court was dismissed. Dissatisfied, they unsuccessfully preferred a second appeal to the Court of Appeal which was again dismissed. They argued that there were lots of discrepancies in the prosecution evidence. In addition, they said the court failed to determine the competence of the caution statements.
