The Appellants were jointly and together charged with the offence of cattle theft contrary to section 268 of the Penal Code [Cap 16 R.E. 2002]. The trial District Court of Iringa convicted them of the offence charged and sentenced each to 15 years’ imprisonment. They were dissatisfied and appealed arguing that the prosecution had not proved its case beyond reasonable doubt. The Respondents supported their appeal.
