The Appellant was convicted of robbery with violence
contrary to sections 285 and 286 of the Penal Code by a District Court and
sentenced to 15 years’ imprisonment. On appeal to the High Court the High Court
set aside the sentence of 15 years’ imprisonment imposed and substituted it
with a 30 years’ imprisonment and twelve (12) strokes of corporal punishment.
On further appeal to the Court of Appeal the power of the High Court to enhance
the sentence was considered.
