The Appellants were convicted by the High Court, sitting at
Tanga in Criminal Sessions Case No. 5 of 2000 (Longway, J.) of the charge of
murder contrary to section 196 of the Penal Code. They were found to have
murdered one Daudi Thomas Shenkala and were sentenced to suffer death by
hanging. On appeal to the Court of Appeal the Appellants contended that the
trial judge was wrong to find that the Appellants were found in possession of
the head of the deceased and that there was no sufficient evidence for arriving
at a conviction.
