The Appellant herein was charged and convicted of murder,
and was sentenced to mandatory death by hanging. Being aggrieved with such
decision the Appellant filed this appeal advancing several grounds of appeal
such as the conviction was based on exhibits (medical report and drawn sketch
map) which were questionable both in law and in fact, and the judgment was
premised on circumstantial and hearsay evidence. In determining the appeal, the
court considered the following aspects of the law in relation to the facts of
the case, the doctrine of “the last person to be seen with the deceased, the circumstantial
evidence, the credibility of witnesses, contradictions/inconsistencies in the
evidence of the prosecution witnesses and whether the sketch map and the
medical report, were properly tendered.
