The Appellant was charged and convicted for defilement of a
girl child aged 14 years contrary to the provisions of section 136 (1) of the
Penal Code [Cap 16 R.E. 2002]. Being aggrieved by such decision he filed this
appeal advancing five (5) grounds of appeal, however upon hearing the court
considered the following main grounds: Whether or not the Appellant was in fact
charged with, convicted and sentenced under the repealed provisions of law. And
if the answer in the first issue is in the affirmative, then what was the
effect of such conviction and sentence. Both parties supported the appeal.
