There was a Settlement Deed between the 1^st Defendant and the 2^nd Defendant. The Plaintiff sought a declaration that the Settlement Deed was unlawful, null and void ab initio and that the Plaintiff was the rightful owner of the assets in question. The Defendants challenged the jurisdiction of the High Court Commercial Division to entertain the suit.
