The applicants had filed a Notice of Motion to apply for stay of execution of the decree under rule 11(2) (b) and (c) of the Court of Appeal Rules 2009 (the Rules). But the Respondent, filed a notice of preliminary objection that the application for stay of execution was unmaintainable as the notice of appeal was invalid.
