The Appellant sued the Respondent praying for a declaration
that the plaintiff (Appellant in this appeal) is the rightful owner of Plot No.
113 Block A, Mbezi Beach, Dar es Salaam. On the other hand, the Respondent
claims to have purchased the disputed land and that although the plot was first
granted to the Appellant, the offer was later revoked by the District Land
Officer after the Appellant failed to pay the requisite land rent.
