The Respondent was the applicant before the Ward Tribunal of Dindira in Application No. 37 of 2009. He filed the application in the Tribunal claiming the Appellant had trespassed onto the school property/land measuring about 3 acres. After a full trial, the Ward Tribunal entered decision in favour of the Respondent. Aggrieved by that decision the Appellant appealed to the District Land and Housing Tribunal of Tanga, Land Case Appeal No. 1 of 2009 where he again lost his appeal and hence he preferred the appeal to the High Court (Land Division).
