Upon death of the deceased the Petitioner, daughter of the deceased, applied for the letters of administration in the Urban Mwanza Primary Court vide Probate and administration cause No. 128/1999 which was made public on 21/6/1999. Respondent, the grandson of the deceased, on his part together with his brother petitioned the High Court for letters of administration Cause No. 12 of 1999 which was cited in the Official Gazette of 19/11/1999 and was successfully granted. The grant was however, revoked upon application No. 74/2000 filed by the Petitioner. Upon the said revocation the Applicant then petitioned the High Court for letters of administration cause No. 8/2000 the present petition. Having discovered that Petitioner had applied for letters of administration, the Respondent applied to be joined as a co-administrator.
