The Appellant was charged of rape in the District Court of
Rombo Mkuu. According to the record, he was convicted in the same year and
sentenced to 30 years’ imprisonment. He appealed to the High Court and in 2009
a retrial was ordered hence the proceedings which gave rise to this appeal. In
this appeal he filed three grounds of appeal, however, the Court took into
consideration the validity of the proceedings conducted by the District Court
and whether the order for retrial by the first appellate court was proper.
