Parties entered into an agreement for supply of ancillary
services. The Appellant breached the agreement by refusing to pay consideration
to the respondent, hence the respondent lodged a case in the High Court. On the
other hand, the Appellant lodged a petition to stay the case on the ground
that, the dispute ought to have been referred to arbitration. The Court
dismissed the petition, hence, this appeal. The issue before the Court was
whether or not the Dispute Resolution Clause in the agreement imposed mandatory
requirements to the parties to refer to arbitration.
