The applicant to this application is also the plaintiff in Civil Case No. 36/2010 which is pending before this court. The Respondents are also the defendants in that pending suit. The application which is brought under sections 55(a), 57, 58(c) and 129 of the Civil Procedure Decree, Cap 8 as well as under Orders XXII rule 1, XXX rules 2, 4(1)(a), 7(a), 18 and 19(1)(2) of the Civil Procedure Rules, Cap 8 seeks for the ordrs that the court allows the applicant adduce her evidence by way of filing her affidavit and in the alternative, issues a commission or a letter of request for the applicant to be examined outside the local limits of the court. The application is vehemently opposed by the Respondent.
