The Appellants were charged with and convicted by the High Court of the murder of one Rashid Monko. They were each sentenced to suffer death by hanging. Dissatisfied with the decision they appealed to the Court of Appeal on three different grounds that the prosecution failed to prove that Rashid Monko was in fact dead; the extrajudicial statements were uncorroborated and that such statements were obtained illegally. The Respondent’s Counsel conceded to all these grounds and did not support conviction by the trial court.
