In this application the applicant is seeking to review
the decision of this Court. Before hearing started, the Respondent raised a
preliminary objection to the effect that, the jurat in the affidavit in
support of notice of motion is incurably defective for being wrongly attested.
The issue before the Court was whether or not the preliminary objection has
merit given the amendment of section 8 of the Notaries Public and
Commissioners’ for Oaths Act, Cap 12 by section 47 of the Written Laws
(Miscellaneous Amendment) (No. 2) Act, 2016 - Act No. 4 of 2016.
