In a suit before the High Court, the parties were Dunia Worldwide Trading Company Limited and the Presidential Parastatal Sector Reform Commission (PSRC). Subsequently, a statute vested all powers and liabilities of PSRC to Consolidated Holding Corporation (CHC). After determination of the suit, PSRC filed a notice of appeal. Without taking formal steps, the name PSRC was substituted with CHC. This substitution attracted a preliminary objection. The Applicant argued that the substitution was done by operation of law and thus it was not necessary for them to make an application to the Court as it was expected to take judicial notice of the existence of the law. Another preliminary objection was predicated on defects in affidavits, which were filed by the Applicant. The Court of Appeal considered, among others, the issues raised.
