The Applicant moved the Court to examine and reverse the order made by the High Court which struck out Miscellaneous Land Application No. 178 of 2016. In that application, the applicant had sought leave to appeal to the Court against the ruling and order of the High Court in Misc. Land Application No. 96 of 2016 and issue a certificate that there were points of law worth consideration by the Court of Appeal. The applicant filed for revision on the ground that the parties were not accorded opportunity to submit on the issue whether or not the application was omnibus and this amounted to a denial of the basic right to be heard.
