The Respondent was a loan
customer of the Appellant whereby he used to obtain loans for facilitating his
business. He had initially taken loan twice from the Appellant. On the third
time he asked for a loan of Tshs. 5,000,000/- which was approved on 07th
January 2015. The Appellant deposited the money but then blocked the
Respondent’s account to prevent him from withdrawing the money. This happened
after the Appellant visited the Respondent’s business place and got informed
that the Respondent had shifted his business to another place. The act of
blocking the Respondent’s account prevented him from purchasing goods ordered
by his customers something which led to cancellation of the orders by the
customers, hence loss of business on his part.
The Respondent thus filed a suit in the RMs court claiming,
among other things, general and special damages to the tune of Tshs.
69,900,000/-. Judgment was entered in his favour whereby he was awarded among
other things Tshs. 42,000,000/- as specific damages and Tshs. 20,000,000/- as
general damages. Hence this appeal by the Appellant.
