The Appellant had earlier on unsuccessfully appealed to the High Court against the decision of the District Court, before which he was charged with the offence of armed robbery contrary to section 287A of the Penal Code. He was found guilty, convicted, and sentenced to a prison term of 30 years. The Respondent informed the Court that the appeal was incompetent on the ground that the first appeal before the High Court was a nullity as it was heard without there being a notice of appeal as required by section 361 (1) (a) of the Criminal Procedure Act [Cap 20 R.E. 2002].
