This appeal is against the ruling and order of the High Court whereby, the Appellant who is the Executive Director of Twaweza, a Non-Governmental Organization, applied for order of certiorari, mandamus and prohibition against the Respondents following withholding of his passport for the reason that, his citizenship status is under investigation. One day, while en route to Kenya with the emergency travelling document, at the Immigration Check-in deck within Julius Nyerere International Airport, he was stopped by the Respondents’ officers from travelling stating that the Appellants’ citizenship status was still under investigation. When all his efforts to get back his passport were unsuccessful, he decided to pursue justice in court. He first sought and obtained leave of the High Court and then proceeded to file an application for prerogative orders. The High Court upon hearing the parties dismissed the application for lack of merit. The Appellant aggrieved by the High Court decision and filed the current appeal.
